THE NECESSITY OF ESTABLISHING CRIMINAL LIABILITY FOR ILLEGAL USE OF NON-LETHAL WEAPONS
(Die Notwendigkeit einer strafrechtlichen Verfolgung des illegalen Gebrauchs non-letaler Waffen)
hebt der Autor hervor, dass non-letale Waffen von Kriminellen bereits jetzt häufig verwendet werden:
"Nowadays objects defined as NLWs are widely used by the criminals because there are no laws or regulations that provide punishment for illegal actions with NLWs. Besides such popularity of NLWs is caused by their special technical-criminalistic properties…".
Der Autor weist in diesem Kontext auch auf veränderte elektronische Geräte (“transformed electronical devices“) hin.
Der Experte verlangt die strafrechtliche Gleichstellung von nicht-tödlichen Waffen mit Schusswaffen und fordert - unabhängig von den Absichten der Täter - diese als lebensbedrohende Waffen zu betrachten und deren Gebrauch entsprechend hart zu bestrafen!
"It highlights the necessity of a criminal liability system for illegal actions with NLWs. Illegal action include illegal purchase, sale, use, storage and manufacture of any Non-Lethal Weapon. Then the use of NLWs when committing a crime would be considered as an aggravating element – qualifying the presence of fire arms. Introduction of criminal liability for illegal actions with NLWs means defining their legal status as objects of crime. Then illegal actions with such objects will be classified as a threat to life security despite of intentions and will contain formal components of crime… The problem can be solved only as a result of collaboration of various specialists: criminal experts, specialists in injury medicine, specialists in microwave [!] devices, radio physics, bioacustics, explosives etc.”</HTML>
